Terms of Service
These Terms form a legal agreement between you and Extra Creative Limited (異想創意有限公司, the "Company") regarding your use of this website and related services. By using this site or commissioning us, you confirm you have read and agree to these Terms.
1. Scope of Services
We provide integrated services across film production, education content, web systems, space design and brand design. Specific deliverables, timeline and fees for each project are governed by the individual contract — information on this site is for initial reference only.
2. Contract Formation
After you request a quote, we reply within 1–2 business days. A contract is formed only after both parties agree on scope, timeline and quote, and sign the contract. We reserve the right to decline projects.
3. Payment Terms
Standard payment schedule: (1) 30% on signing; (2) 40% at post-production; (3) 30% on completion. Fees are quoted in NTD and include tax. Payments overdue more than 7 days may result in service suspension and 5% annual late interest.
4. Intellectual Property
Upon full payment, copyright in final deliverables (films, design files, code, etc.) transfers to the client. We retain rights to display work in our portfolio and use it for marketing (including credit attribution). Stock libraries, fonts and third-party packages remain under their original licenses.
5. Revisions
Standard contracts include 2 rounds of revisions (each within 20% of original spec). Out-of-scope changes are quoted as new work.
6. File Retention
After completion, deliverable files are downloadable for 1 month; raw materials (footage, PSDs, etc.) are deleted after 3 months. Notify us in advance if you need long-term backup.
7. Confidentiality
Both parties undertake to keep confidential any information learned during the project, from contract date through 2 years after project completion.
8. Termination
Either party may terminate with 14 days' written notice. Work performed is billed pro rata; prepaid unused amounts are refunded. Neither party is liable for non-performance due to force majeure (natural disaster, war, pandemic, etc.).
9. Limitation of Liability
Our total direct damages liability is capped at the actual project fee received. We are not liable for indirect, incidental or consequential damages — except in cases of willful misconduct or gross negligence.
10. Governing Law & Jurisdiction
These Terms are governed by ROC (Taiwan) law. Disputes shall be heard in the Taiwan Taipei District Court as court of first instance.
11. Updates
We may revise these Terms periodically. The latest version is published here and effective on its publication date.
